DEFINITIONS:
“The Company” means DealDrivers Ltd. UBuyCars.co.uk is a trading style of DealDrivers Ltd, for used cars.
"Conditions" means the conditions set out in this document
"70 Point Car Check" means the vehicle inspection to be carried out by Us in accordance with the 70 Point Car Check list shown on our webpage of the same name on this website. "We/Us/Our" means the garage selected by DealDrivers Ltd to carry out this 70 Point Car Check service
"You/Your/Customer" means You the individual, the person, firm or company, who requests our own stock of 70 Point Car Check vehicles from Us
CONDITIONS
- The Conditions shall apply to the provision of the 70 Point Car Check to the exclusion of all other terms and conditions and no variation to these Conditions shall be binding unless agreed in writing by Our authorised representative. If you require any changes please ask for these in writing.
- Unless agreed in writing by Us the 70 Point Car Checks shall not be deemed to incorporate any opinion expressed by Us in relation to vehicle values or rectification or repair costs. Any estimates for repair/rectification or values given by the engineer in connection with a check reflect the subjective opinion of the mechanic or engineer concerned and are given solely as a matter of goodwill.
- Except as provided below, We shall inspect those items listed on the 70 Point Car Checks sheet and report to You in respect of any defects We identify.
- Repairs and replacement panels shall not be deemed a defect if carried out to a professional standard and We shall not be obliged to report to You in respect of such repairs/replacement panels.
- The durability of an exhaust or clutch system is difficult to forecast and where such items have not been identified as faulty this does not imply that such systems will be have an indefinite life expectancy from the time of the 70 Point Car Check.
- We will not be obliged to carry out a test drive if a vehicle seller is unable to confirm that the vehicle concerned has a valid MOT. The carrying out of a test drive does not mean that we have seen a valid MOT certificate.
- We shall not be responsible for rectifying any defects or carrying out any repairs identified in the 70 Point Car Check, unless that fault makes the vehicle unroadworthy and is required to be resolved before sale. Any faults uncovered in the 70 Point Car Check will be made clear to any prospective buyer.
- We shall only inspect those items reasonably accessible and (without limitation) We shall not inspect or report on:
- internal mechanical items or any item where inspection requires disassembly of any parts or components
- computer and satellite navigation systems
- exhaust emissions
1. Subject to the following terms a Used Car purchased from DealDrivers Ltd may be returned by prior arrangement and appointment, provided that:
a. The Car is returned to DealDrivers Ltd used car secure storage unit within 30 days of the original handover date;
b. The Car has not been driven more than 1000 miles since original handover to the Customer;
c. We, at our own discretion, must be satisfied that the Car is in the same condition as at the time of original handover to the Customer;
d.We are satisfied that the Customer owns the Car and is fully entitled to return it under these Terms and Conditions;
e The Car was not a 'special offer' vehicle shown as ‘sold as seen’.
2. Before any exchange is affected under this Terms and Conditions We will use reasonable endeavours to assist the Customer in terminating any financing agreements relating to the purchase of the Car but where the Customer has used a third party funder the completion of such an exercise will ultimately be between the Customer and the funder. DealDrivers Ltd will not reimburse the Customer for any finance charges directly resulting from the returned vehicle.
3. Where the Customer wishes, instead, within the 30 days/1000 miles limits, to exchange a Car for another Car in stock at DealDrivers Ltd with a higher price the Customer must pay to the Retailer the difference in price. In this instance the Customer will be responsible for any additional costs incurred in the exchange relating to licensing and insurance of the second Car.
WARRANTIES, LIABILITIES
- We warrant that the 70 Point Car Checks will be carried out with all reasonable skill and care by a third party specialist provider selected by DealDrivers Ltd.
- Any warranty or guarantee given by Us in respect of the 70 Point Car Check shall be subject to the following conditions:
a) We shall not be responsible for verifying the accuracy of odometer readings or confirming the service history of any vehicle.
b) We shall be under no liability or in any way responsible for any defects which would not have been apparent on the inspection of the vehicle.
c) We shall be under no liability in respect of any defect arising from wear and tear or where, at the date of inspection, performance of the item was satisfactory.
d) We shall be under no liability in respect of any opinion expressed by Us as to the likely costs of any repairs or costs of rectification (and any such opinions expressed by Us shall not be deemed to be comprised in the 70 Point Car Checks).
- We shall not be liable to You for any loss of profits, economic loss and loss of goodwill (direct or indirect) or for any indirect, purely economic losses incurred as a result of or in connection with any 70 Point Car Check whether resulting from breach of contract, negligence, breach of statutory duty or otherwise.
- Our liability for any delay in performing or any failure to perform any of Our obligations in relation to the 70 Point Car Check shall be limited to the excess (if any) of the cost to You in the cheapest available market to replace the services not performed.
- Nothing in these Conditions is intended to nor shall it limit any liability on Our part in respect of death or personal injury caused by Our negligence.
- Where You are dealing as a consumer Your statutory rights are not affected by these Conditions.
- If any provisions of these Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of these Conditions and the remainder of the provisions in question shall not be affected thereby.
- Any notice given hereunder must be given in writing and delivered or sent by post or facsimile transmission to the residence or principal place of business of the party to whom it is addressed.
- Except as otherwise provided nothing in this Contract shall confer on any third party any benefit or the right to enforce any terms of this Contract.
- The Contract shall be governed by the Laws of England and subject to the jurisdiction of the English Courts.

All of our used vehicles in our own Cirencester stock are checked to make sure that they are of the highest standard of used vehicles on the market. Our HPI Check includes the following:

This Agreement of Terms does not affect any of the Customer's statutory rights.
